Poll: Marylanders Favor Life Without Parole Over Death Penalty

A new poll by Annapolis-Based Gonzales Research shows support for banning assault weapons while only 25 percent of those polled want to see Gov. Martin O'Malley run for President.

 

Nearly two-thirds of Marylanders surveyed say a sentence of life without parole is an acceptable alternative to the death penalty.

The results are part of a survey released early Wednesday morning by Annapolis-based Gonzales Research.

The poll 801 state residents found that support for the death penalty in the state has slipped to 49 percent. In 2011, that same poll found that 56 percent of those polled favored the death penalty.

Opposition to the death penalty comes from Democrats and blacks at nearly 60 percent each. Republicans, independents and whites all favor the retention of capital punishment, according to the poll.

Gov. Martin O'Malley has made the repeal of the death penalty one of his legislative priorities for the 2013 Maryland General Assembly session.

Support for Stricter Gun Laws

At the top of O'Malley's legislative agenda is a slate of stricter gun laws.

Statewide, 58 percent of those surveyed said they would favor banning the sale of assault weapons.

The poll also found that 88 percent of those surveyed favored background checks for people purchasing firearms at gun shows.

Also, about 44 percent of those surveyed said stricter gun laws would do more to prevent violence in schools compared to 36 percent who said armed guards or police officers would reduce violence in schools.

Public Supports Transportation, Rejects Taxes

In an interesting juxtaposition, 94 percent of those surveyed believe it is important to maintain state roads and bridges but a majority of all groups surveyed did not favor a gas tax increase to support those projects.

Only 26 percent of those surveyed said they support a 10-cent per gallon increase in the state gas tax compared to 73 percent in the same poll that said they oppose that tax.

The strongest support for a tax increase comes from Democrats with 36 percent being in favor.

Republicans, independents, men and women all oppose the tax—89, 75, 75 and 71 percent respectively.

Majority Approves of O'Malley Performance, Not Presidential Aspirations

O'Malley's job approval remains essentially flat compared to the same time last year with 54 percent of those surveyed saying they approve of the two-term governor's performance.

Women and blacks, 61 and 78 percent respectively, were the strongest supporters of O'Malley, according to the poll. Only 46 percent of men and whites respectively said they approved of the job O'Malley is doing.

A year ago, O'Malley's approval was 53 percent. His lowest job approval numbers, 37 percent, came in March 2008.

Despite the majority approval, most surveyed said they did not want to see the governor run for President.

Of those surveyed, only 25 percent said they believed O'Malley should run for President in 2016 while 58 percent said he should not and 17 percent were not sure.

The governor is widely considered to be interested in running for president in four years and recently created a federal campaign account.

I'm a Canadian, and at one time we too had the death penalty...no more. I personally have no problem with this, as sometimes people that are innocent face and pay the ultimate penalty and for me one wrong death is one too many...I also feel that executing the convicted is doing them a favour. When it comes to murder, I am one that is not that nice and believe doing the murdered a favour is the last thing I want to do...I prefer you lock them up, preferably in solitary and you let them rot there for the rest of there miserable lives...let everyday be a reminder of why they are there. Right now in Canada, Luke Magnotta, the guy accused of beheading Jun Li is getting ready for trial..most likely he will be found guilty, and most likely under Canadian law get life with no chance for parole for 25 years...that does not mean he will get out in 25...it just means that is when he can start asking for parole, which most likely he will never get...to me this is a fair sentence, especially in his case.

In the States it has been proven that the majority of people on death row are non-white, basically uneducated, poor, and come from broken and disfunctional homes...now I am in no way making excuses for what these people have done...not in any way...but when you can't get a lawyer, at the same level as a rich white, and you are up against it because your of another colour or race, is that really fair?

In his written justification for the proposal, Haller notes that mass shootings are rarely spontaneous events. They often involve premeditated planning; according to the government report issued after Columbine, "Most attackers engaged in some behavior prior to the incident that caused others concern or indicated a need for help."

His other recommendation is a "Firearm Safekeeping Law" which would make it a misdemeanor, or possibly a felony, to store guns in such a way that they could fall into the hands of someone with a mental illness. The proposed law is written so that it only applies in a case where a mentally ill or violent person actually does obtain the weapon, not where they merely could have."

Idaho is great. It is a beautiful state with great outdoor life. Something Carroll County use to be. Then, the urban sprawl arrived, and started the ruination of the country lifestyle that the county had. I have roots that have been in the southern Carroll County area for over 150 years. I miss family and friends but I don't miss congestion and the liberal agenda that has been invading that area. And with redistricting, their probably won't be any conservative representation for quite a while.

I'm actually contemplating a move to Idaho myself. I have a brother there and he's been quite happy and he's not close to being an Aryan Nation member or supporter. It's beautiful there and the cost of living is not nearly as high as it is around here. Oh and the summers are dry.

This same research firm in a Sept 26, 2012 poll had the Dream Act 58%-34%-8% (For-Against-Undecided), Same-Sex Marriage 51%-43%-6%, and Gambling 45%-46%-9% on a sample size of 813 voters with a 3.5% margin of error and a 95% probability that if you counted 100% of the people this is the range.

Dream Act passed with 58%, Same Sex marriage with 52% and Gambling with 52%.

Looks like Dream Act/Same Sex undecideds swung to No in October while gambling undecideds apparently went Yes.

Having O'Malley as Governor is a death penalty. Gonzales who ran the poll (which BTW is probably about +/-6 % because so few were polled, has VERY liberal clients on his website. Pikesville Patch would do itself a favor by not using such a liberal polling company and then skewing the headline. 49% favor the death penalty and that is pretty much split in my opiniion (again +/-6%). Maryland is already is one of the worst states to own a gun and ranks 8th in the country for violent crime rates! Do you think there might be a connection?

This is a tactic of death penalty opponents that is very often over looked: they drive up the legal costs of capital punishment through a drawn out legal process littered with regulation and automatic appeals (whether or not the convict wants to appeal). Once the cost of of execution is greater than the cost of housing them they have eliminated the above argument.

The appeal process of capital cases is secondary to getting a guilty verdict overturned. It is all about delay and driving up the cost to the state.

That's what the media would like you to believe. The DNA testing means that it was not there blood, sperm (or other body fluid) collected at the scene. Which creates enough doubt to overturn a verdict. It doesn't mean they were innocent of the crime

For me it is just lock them up forever. Government murdering its citizens just makes no sense no matter how evil they are. Offering suicide pills just might make some sense, probably get quite a few takers after residing in jail for a long time.

What is interesting is Americans' need for killing prisoners to be "painless, quick, efficient, antiseptic and private" unlike many other countries where hanging or a swift removal of the head is done in public.

The movie "No Escape" has some interesting theories, but somewhat barbaric.

I am more of an "eye for an eye" guy. If I knew somebody murdered one of my loved ones, they would never make it to trial. I would do the average penalty for that.. which is about 18 months in a mental hospital. It would be worth it.

PHP, the reason I asked is you stated "It was very eye opening this morning to read that there was NO assault rifle used in the Newtown shooting" which was why I questioned you. The video you read was from almost immediately after the shooting and has been proven false many times over. The children and the adults were shot with an AR-15 knockoff, commonly considered an assault weapon by the ATF. Many on the right wing will quickly say it is not an "assault weapon or assault rifle" because it doesn't have an "automatic" firing mode. It fires as fast as the gunman can pull the trigger.

That is really not consequential to the discussion, these children were shot with a military round from this "rifle" multiple times, some up close, some at a distance. The bullet travels at 3 times the speed of sound, the kids didn't even hear the bullet that hit them in the head.

Before you get your dander up, please go read the facts.

This is far more fair than the victim and their families have to endure. I skimmed through and did not see anything about cost comparison with more prisons. Capital cases cost more because Democrats have designed it that way to say it costs more. As for a deterrent. Studies have shown that it costs less to keep a prisoner locked up for life than to go through the requirements for execution. However, we cannot ignore the other consequences of the death penalty, namely as a deterrent. Although some individuals may not care about the death penalty, there may be numerous others who do not cross certain criminal lines because of it.

Contrary to popular belief, punishment as a deterrent is a valid and supported theory in psychological, social, political, and legal fields. In an article on information security, the authors found that individuals with low self-control responded better to punishment than other forms of deterrents (Workman & Gathegi, 2007). One experimental study concluded that, contrary to some empirical literature, severity of punishment was a more effective deterrent than probability (Friesen, 2012). Another study used a change in sentences in Italy as an opportunity to observe results; the conclusion was that increases in sentences resulted in a reduction in recidivism (Drago, Galbiati, & Vertova, 2009). There is even an article on US data over a 40 year period, using 96 different regression models, that found capital punishment had a noticeable deterrent effect on overall murder rates (Dezhbakhsh & Shepherd, 2006). I would say that these, and the many more research articles, studies, etc., account for valid and reliable proof of deterrence theories.

Almost every recent scientific study on deterrence theory and behavioral patterns agrees that punishment is a better deterrent for average to low self-control individuals, including the use of the death penalty and its effects on murder rates. The article provided by Amnesty.org wasn't peer-reviewed, pulled information from other non-profit non-peer-reviewed articles, and simply re-hashed what was already written by these other organizations.

There are many ~opinion pieces~ that disagree on death penalty as a deterrent. The valid, reliable, and reviewed ~professional articles~ tend to agree that that the death penalty works as a deterrent. I did my research via an academic library, not via Google.

So, this analysis finds any correlation inconclusive. Therefore we should only look at it from a fiscal standpoint? I suppose we could follow their recommendation, in which case we should leave things exactly as they are and wait for more research.

Unfortunately, O'Malley doesn't want to do that... he wants to pass legislation that changes the current status quo, even though (according to the NRC analysis) there is no proof that the death penalty increases, decreases, or has negligible effect on crime and that policy should not be affected by such until further research is gleaned.

The reason for the length of time it takes to kill someone is because of the number of innocent people who may have been/were executed. Once that bell is rung it is over. There is a report of one guy being brought back from the dead a couple thousand of years ago.

He spent 2 years on death row before being resentenced to life in prison. Throughout his almost nine years in prison, he insisted that he was "an innocent man" and signed all of his letters with that acronym, "A.I.M." In 1993, he was exonerated when DNA testing revealed that the semen found on the victim's clothing did not match Bloodsworth. Had I known then what I know now, I would have given Alcala and the others the alternative sentence of life in prison without the possibility of parole. Actually, according to my statistics knowledge (and the formula), given the Maryland population you only need ~385 polled people to have a 95% confidence level with an interval of 5%. At ~800 polled people, you could have a 95% confidence level with an interval of 4.5%.

Amusingly, to have a 99% confidence level (+/- 5%) in Maryland, you need ~666 people... let the religious nuts chew on that.

I've voted across party lines over the years, and have no axe to grind against either party. That being said - I was not polled for this survey and I'm very much in favor of the death penalty. No, it will not bring back murdered victims but it'll make VERY sure that their killers aren't free to kill again. And I don't care WHAT kind of "life without parole" sentence a person gets, as long as he's alive, there is always a chance, no matter how slim, he'll go free. And as far as life sentences go; I can think of many, many other uses for my tax dollars than to feed, clothe,and shelter monsters. Like maybe helping the victims of crime?

The average cost to house feed and support an inmate in a local and state facility depending on the programs the department has offered ranges from $ 26,000.00 to 38,000.00 per year. That is a salery of some lowly paid employees. Mulitply that by the number of inmates incarcirated across the state is over 23,000.00 not including the local jurisdictions so just with inmates incarcerated in the state facilitys that comes to 598,000,000. That five hundred ninty eight million dollars.

That is where you and I disagree Chris W. CJ Roberts talked about settled law but I don't believe he will follow through when it comes to abortion. I believe four members of the SCOTUS would overturn Roe v Wade in a blip. I also believe Heller is only as good as the 5-4 decision handed down five years ago. I see Obama for the next four and either Biden or Clinton for the next 8. That will change the make-up of the court and Heller will be at risk as written. What does that mean, you can own a gun but with a lot more restrictions imposed on you by the various states and cities.

But until then the only guaranteed outcome is death by gun, just when and where. Sort of random actually other than the inner city gangs and drug trade.

But if I could predict the future I would be at the casinos and Wall Street.

I'm not surprised by your view.

For me it is a question of consistency. Our legal system is based on precedent. Lower courts may disagree on a particular issue, but once SCOTUS rules, that's it.

The rare exceptions where SCOTUS has reversed itself were in cases where they wrongfully ignored very basic rights such as prior support of the Jim Crowe laws, and more recently the state and local sodomy laws.

Whether you or I like one or the other, Roe and Heller are both precedent that cannot easily be set aside. The whole point is to avoid taking sides politically. A more liberal court may have decided Heller differently, but is has now been decided. To reverse decisions based on shifting political support would undermine confidence in the judicial system.

Difficult issue. Although I do believe the death penalty should stay, I do understand those who object. Fair arguments. The other argument against the death penalty in my mind is that I do believe police officers and law enforcement officers "help cases along" to put it mildly. If we are to keep the death penalty on board - I would suggest strong criminal time if under further investigation,it is determined law enforcement officers and prosecuting attorneys have in fact made false statements, tampered with evidence or not followed procedures in order to win cases.
I am still baffled by those who are concerned that we could wrongfully sentence an innocent person to death, yet support abortion. What crimes against humanity have these unborn babies committed?

Second, having the death penalty at least available is huge for these cowardly murderers who attempt to control proceedings by NOT disclosing where bodies of their victims are. They are cowards and don't want to die. The families of vicitms simply want to bury their loved ones in peace and get closure. I've known many people who spent time on both sides of the bars. Frankly, I can't tell you the difference.

This is particularly true given that the greater part of inmates in state institutions are there because they are poor, under-educated, black and convicted of a drug-related offense.

I don't question the results of the poll because MD is a hard left state politically. Right up there with NY, MA, VT, RI, CA, etc. I question why 54 percent of the people would approve of a guy who has raised or attempted to raise virtually every tax in this state. I question why people would support a guy who is presiding over a state that businesses continue to flee due to the unfriendly business climate that exists here. I question why people support a guy who is obsessed with ending capital punishment when it is practically non existent here anyway. I question why they would support a guy who is as partisan and nasty as any politician I have ever seen and clearly is using his office to position himself to the far left for the democrat presidential primary. Wake up MD before it is too late.

amark: Interestingly enough, 8 of the 10 wealthies states are "hard left" as you say.
Also, the highest population states almost entirely vote Democrat.

If you guys want to move to one of those intellectually and technologically deficient western states, by all means....don't let the door hit your collective asses on the way out.

I don't love much of what O"Malley spews, but suggesting this state is 'in trouble' is patently, factually false.

That would have been a good place to start. Also are we talking per capita income? Because yes many of those are leftist, so what? Are you drawing the conclusion that liberal legislation has led to such prosperity for the people? Many other "rich" states (CA, IL, NY, NJ) are basically bankrupt because of guess what? Notice how all these Polls are taken in Balt.City,PrinceGeorges Co and Montgomery Co . Amazing is'nt it. Because most of the Prison Population is from these three sections of the state. And was'nt the increase in Tolls and Tags and Licsences supposed to cover the Bridges and Road construction projects? Quess not !!!!! Huh?

Well considering Obama got 90% of the vote in PG Co, and about 70% in Montgomery and that they are the two biggest counties in the state, it's not surprising that the poll shows these results. Of course there will be more people sampled in those places than say Garrett Co. although I don't know what the number of colleges in those places has to do with anything.

I am totaly shocked by some of these comments. I was never for the death penalty until crime hit home. My friend was bruttaly executed along with her sister in law, her 5 year old and 3 year old children in the state of Maryland. So now I ask wtf should I pay for this coward to have his life for however long that may be. Those children didnt get to live their lives, nor did their mother or aunt. So why should he live on my tax dollars and my friends families tax dollars? Why should I provide him with three meals a day, rec time, family visits, education, medical care, and who know what else? He dosent deserve his life....and definitly not at my expense!!!

It costs less money and takes less time to electricute some piece of murdering filth than it does to fry an omelete for breakfast. Electric chair runs off same current as the average electric stove. I fugure it costs maybe $.03 worth of electricity. Sounds like a bargain to me.

Once again, assault weapons are already banned. What they are calling for banning are semi-automatics that only fire one bullet per pull of the trigger and, most of them, aren't even condoned for hunting because of the lack of stopping power of the bullets used.

Let's focus on putting severely mentally ill people in mental institutions where they belong and putting people who use guns in crimes in prisons for long periods of time, where they belong.

Actually, correction to my statement: assault weapons are already incredibly highly regulated. In order to own one legally, you need a special gun license that costs nearly 20K to get, the money to buy one (50K-100K is the going prices for one), and a bunch of other stuff to adhere to the regulations on the special gun license.

Assault weapons are NOT a real worry in the real world.
