Dave & Buster's Given 30 Days to Vacate White Flint Location

A federal judge dismissed a complaint by Dave & Buster's, Inc. Tuesday against the owners of White Flint Mall, ordering the company to vacate the location within 30 days.

A federal judge is giving Dave & Buster's, Inc. 30 days to vacate its space in White Flint Mall.

Judge Roger Titus, a U.S. District Judge in Greenbelt, ruled Tuesday that Lerner Enterprises, the owners of the White Flint Mall, had the right to terminate its lease with Dave & Buster's. By opening a location at Arundel Mills Mall in 2006, the company violated a distance-based lease requirement, the Washington Business Journal reports.

The mall's owners, principals of The Tower Cos. and Lerner Enterprises, originally gave Dave & Busters fair notice in Sept. 2012 though the company failed to respond within a 30-day window. Dave & Buster's now has 30 days to vacate its White Flint Mall location.

The company was one of White Flint Mall's two anchor tenants that sued in federal court to block or temporarily delay the mall's redevelopment into a town center. Dave & Buster's claimed the planned redevelopment violated the original terms of its 35-year lease with White Flint signed in 1995.
