Both men were charged with first-degree murder, first-degree assault, first-degree conspiracy, armed robbery and use of a handgun in commission of a felony in the August 2010 shooting of Julian Kelly. Jurors heard Julian Kelly's account of his assault and shooting Friday during a 12-minute video recorded from a police officer's vehicle. The conversation may have been one of Kelly's last, as police and family testified that he was unable to vocalize after arriving at the hospital. Attorneys for Charles Baxter and Shamire Moore argued Tuesday that their clients should not be on trial for murder. Baxter and Moore face first-degree murder accusations in the shooting death of Julian Kelly last August. Barbara Graham, Moore's lawyer, told jurors that Kelly and her client did argue and fight that day, but Moore wasn't involved in a mob beating. As the two men fought, Kelly pinned Moore to the ground, Graham told jurors, and Baxter joined in to help his friend. "When they got away from him, they were done," Graham said. Both men are accused of robbing and shooting Julian Kelly while he walked home from a bus stop. The trial of two men charged in the August 2010 shooting death of Julian Kelly has been pushed back for the third time, according to the Montgomery County State’s Attorney’s office. A third suspect remained at-large. Kelly was robbed and beaten by four young males while walking home from a bus stop near the 14000 block of Castle Boulevard on Aug. 21, 2010, according to police.
